Terms & Conditions – Carla Art Studio

1. Intellectual Property
All artwork, images, designs, branding, packaging, and website content are the intellectual property of Carla Art Studio and protected by copyright and other laws. You may not copy, reproduce, publish, distribute, modify, or create derivative works from any content without prior written permission.
Upon purchase, you receive a personal, non-commercial license to display the physical print you buy. Reproduction (including scanning/photographing for prints or merchandise) is prohibited.
2. Prices, Payment & Currency
All prices are in Australian Dollars (AUD). We accept Visa, Mastercard, PayPal, and Stripe. Carla Art Studio does not store full payment details. International bank fees or currency-conversion charges are the buyer’s responsibility.
Prices, shipping fees, and availability may change without notice. If we discover a pricing or listing error, we may cancel and refund your order.
3. Pre-Orders & Made-to-Order Items
All artworks are sold via pre-order unless stated otherwise. When you place an order, you’ll receive an order-confirmation email; the sale is accepted when we send that confirmation. We reserve the right to refuse or cancel orders (e.g., suspected fraud, stock/printing constraints, pricing errors), with a full refund.
After the pre-order window closes, printing begins (approx. 1 week), followed by hand-finishing, packaging, and dispatch. Processing times are estimates and may extend due to unforeseen circumstances. We may ship items separately at our discretion at no extra cost to you.
4. Shipping & Delivery
Orders ship from Melbourne, Australia, with tracked delivery. Estimated delivery times after dispatch:
Australia (Express Post): 1–2 business days
International Standard: approx. 2–4 weeks
International Express: usually 5–8 business days (destination-dependent)
Currently, shipping to the United States is unavailable due to international carrier restrictions. We hope to reopen U.S. shipping soon.
Delivery timeframes are estimates and can vary due to customs and carrier delays. International customers are responsible for any customs duties, taxes, or import fees.
Please ensure your shipping address is accurate. We are not liable for parcels lost due to incorrect or incomplete addresses. If tracking shows Delivered but you haven’t received the parcel, contact us within 7 days so we can lodge a carrier investigation. We are not responsible for parcels lost or stolen after being marked delivered.
5. Returns & Refunds
Because each piece is made-to-order, we cannot accept returns or exchanges for change of mind.
Nothing in these Terms limits your rights under the Australian Consumer Law. If a product is faulty, damaged in transit, or not as described, contact carla@carlaartstudio.com within 7 days of receipt with clear photos of the item and packaging. If approved, we’ll arrange a repair, replacement, or refund to your original payment method. Shipping fees are non-refundable except where required by law.
6. Limitation of Liability
To the fullest extent permitted by law, Carla Art Studio is not liable for indirect or consequential loss, or delays caused by third-party carriers or customs. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.
7. Privacy & Data Protection
We collect and use personal information (name, address, email, order details) to process and deliver your purchase. We don’t sell or rent your personal information. We may share it with service providers (e.g., payment processors, shipping carriers) to fulfill your order or where required by law. For details, see our Privacy Policy.
8. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria. If any provision is invalid or unenforceable, the remaining provisions remain in full force.
